INFORMATION PURSUANT TO ART. 13 OF EU REGULATION 679/2016

(European Data Protection Regulation)

In compliance with the current legislation on the protection of personal data, Fondazione Francesco della Valle ETS” intends to explain to the User how, by whom and for what purposes, the personal data provided when accessing our site, will be processed, and protected and what are the rights of the User with respect to such data.

DATA CONTROLLER

The data controller is Fondazione Francesco della Valle, in the person of its pro tempore legal representative, Mrs. Federica della Valle, with registered office in Padova, Prato della Valle n. 24, C.F. c.f. 92322910289.

TYPES OF DATA PROCESSED

The data processed by the Foundation are common personal data (for example, personal identification data such as name and surname, tax code, address, telephone numbers, email addresses).

If personal data of third parties are disclosed to the Foundation, the User is the independent data controller and assumes the consequent legal obligations and responsibilities, holding back the Foundation with respect to any dispute, claim and/or claim for damages.

LAWFULNESS, PURPOSE AND METHOD OF PROCESSING AND CONSEQUENCES OF FAILURE TO PROVIDE DATA

The collected data are processed for the following purposes:

  1. for the correct and complete execution of the operations envisaged by the contracts concluded;
  2. to comply with legal obligations of an administrative, accounting, civil and fiscal nature and obligations under Community and non-EU regulations and regulations;
  3. to exercise the rights of the Data Controller, for example the right of defence in court;
  4. to carry out marketing activities such as sending advertising material, carrying out market research, commercial communication, promotional activities and newsletters by email or telephone contact.

For the purposes indicated under the letter a) to letter c) the provision of data is mandatory as necessary for the establishment of the contractual relationship. Failure to provide personal data or refusal to provide it will make it impossible for the Foundation to conclude and perform the contract and provide the related services.

For the purposes indicated in letter d) personal data will be processed only if the User has given his consent. The provision of consent to the use of data is optional and failure to provide it does not allow the activity referred to in point d).

If the User wishes to object to the processing of data for the purpose indicated in point d) and revoke the consent given, he may do so at any time without any consequence on the availability of the other services requested or on their operation.

The communicated data are inserted in the corporate database and their processing is carried out through computer and telematic tools, as well as manuals on paper, also with third parties, with the use of logic strictly related to the purposes of collection and to always ensure compliance with the provisions of the European Regulation on the protection of personal data.

If the User is under the age of 18, he cannot provide any personal data or register on the site and in any case Francesco della Valle Foundation assumes no responsibility for any false statements provided by the User. The holder of parental responsibility may at any time request from the Foundation the removal of the data entered and the deactivation of the account improperly created by the child, by making a written request to fondazione@dellavalle.info .

DATA RECIPIENTS

The data are processed by internal resources that are properly trained and that operate as personnel in charge of processing.

Personal data are not subject to disclosure.

The data provided may be disclosed to third parties appointed external data processors such as, as an indication, tax consultants, lawyers, maintenance companies’ computer systems, couriers, credit institutions and insurance, where this proves necessary to fulfil the management and execution of the contractual relationship. The updated list of external data processors is available at the operational headquarters of Foundation.

Finally, personal data may be shared with authorities, bodies and/or subjects to whom they must be communicated pursuant to legal provisions or orders from authorities. These authorities, entities and/or subjects will act as independent data controllers.

INTERNATIONAL DATA TRANSFER

All information is stored on servers owned by the Foundation or outsourced by third parties located within the European Union.

Your personal data may be transferred to non-EU countries in accordance with the legal provisions in force.

RETENTION PERIOD

Personal data will be kept for the time strictly necessary to fulfil the purposes indicated and in any case for the period imposed by law.

After the above-mentioned periods, all data will be deleted or made anonymous by computer and paper archives.

USER RIGHTS

The current legislation on the protection of personal data gives the User the exercise of specific rights:

  • the right of access or the right to request and obtain confirmation of the existence or otherwise of personal data and their provision in an intelligible form (Art. 15 Reg. EU 679/2016);
  • the right to be updated, supplemented, and corrected in the event of inaccuracies (Art. 16 Reg. EU 679/2016);
  • the right to cancellation (art. 17 Reg. UE 679/2016);
  • the right to restriction of processing (Art. 18 Reg. EU 679/2016);
  • the right to data portability (Art. 20 Reg. EU 679/2016),
  • il diritto di opporsi al trattamento (art. 21 Reg. UE 679/2016);
  • the right to withdraw your consent at any time without prejudice to the lawfulness of the processing based on the consent given before the withdrawal and to prejudice further processing of the same data based on other legal bases;
  • 8. the right to lodge a complaint with the supervisory authority responsible for the protection of personal data (www.garanteprivacy.it) based in Piazza Montecitorio No. 121, 00186 Roma – protocollo@pec.gpdp.it .

AUTOMATED DECISION_MAKING PROCESSES

The Data Controller does not carry out processing that consists of automated decision-making processes on the data processed.
